Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the I Was Here website and services (the "Service") provided by Bomani Digital("we", "us"). By creating an account, submitting a record, or otherwise using the Service, you agree to these Terms.

1. The Service

I Was Here is a digital monument that allows users to publish a permanent record of a person's existence, nominate others, and contribute to a shared fund. You must be of legal age in your jurisdiction, or have your guardian's consent, to use the Service.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Provide accurate information and keep it up to date.

3. Acceptable use

You agree not to misuse the Service. In particular you must not:

• Use the Service unlawfully or to publish unlawful content.
• Engage in fraud, spam, or impersonation.
• Infringe intellectual property, privacy, or publicity rights.
• Interfere with security, probe, scan, scrape, or introduce malware.
• Submit records for identifiable living persons without a lawful basis, or nominate/memorialise without appropriate authority.

4. Your content

You retain ownership of the content you submit ("User Content"). You grant Bomani Digital a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display User Content solely to operate and promote the Service, including as part of the public monument. You represent that you have all rights necessary to grant this licence.

5. Intellectual property

The Service, including its software, design, branding, and documentation, is owned by Bomani Digital and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms. You must not reverse engineer, resell, or circumvent technical limits.

6. Payments, billing, tax, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by the Paddle Buyer Terms and our Refund Policy.

7. Service level

We aim to keep the Service available and reliable but do not guarantee that it will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Suspension and termination

We may suspend or terminate your access at any time for material breach, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, published records may remain part of the permanent archive; other account data will be handled per our Privacy Notice.

9. Liability

To the fullest extent permitted by law, Bomani Digital's aggregate liability arising out of or relating to the Service is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law (including fraud, death, or personal injury caused by negligence).

10. Indemnity

You will indemnify Bomani Digital against claims arising from your User Content, unlawful use of the Service, or breach of these Terms.

11. Governing law

These Terms are governed by the laws of the jurisdiction in which Bomani Digital is established, without regard to conflict-of-law rules. Courts of that jurisdiction have exclusive venue for disputes, subject to mandatory consumer protections in your country of residence.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.
